General Terms and Conditions – Racqt.app
§ 1 Scope, provider
(1) These terms apply to the use of the Racqt.app platform (hereinafter "platform") between the provider
Oliver Terp, trading as MOJM, Heinrich-Lübke-Str. 16, 42579 Heiligenhaus, Germany Email: kontakt@racqt.app
(hereinafter "provider") and registered users.
(2) Deviating terms of the user are not recognised unless the provider expressly agrees to them in writing.
§ 2 Description of services
(1) Racqt.app is a SaaS platform for tennis players, coaches and clubs. The provider makes the platform available as a web and, where applicable, mobile application.
(2) The provider owes the provision of the platform within the scope of the plan booked in accordance with the current state of the art. Availability of 100 % is not guaranteed; the aim is an average annual availability of 98 %, excluding planned maintenance windows and disruptions beyond the provider's control.
(3) Payment transactions between users and coaches/clubs are processed through the payment accounts of the respective coach/club. The provider merely provides a technical interface for this and does not become a contractual party to the underlying service.
§ 3 Users, conclusion of contract
(1) The platform is aimed at consumers (players) with free accounts and at entrepreneurs within the meaning of § 14 BGB (German Civil Code) (coaches, clubs) with paid accounts. Paid plans are reserved exclusively for entrepreneurs. Coaches must be registered as a business or as freelancers; clubs act within the scope of their corporate or commercial activities. When booking a paid plan, the user confirms that they are concluding the contract in the exercise of their commercial or independent professional activity.
(2) The contract is concluded by registering on racqt.app and confirmation by the provider (activation of the account). Acceptance of these terms and the privacy policy is a prerequisite.
(3) Users must be at least 18 years old. Minors may only use free player accounts with the consent of their legal guardians.
§ 4 Plans, prices, trial period
(1) Basic use of the platform is free of charge for consumer users (players).
(2) Paid plans are available for coaches and clubs. Prices and the scope of services are set out in the price overview displayed on the platform at the time of booking. All prices are net prices plus statutory VAT.
(3) A 30-day free trial is granted for paid plans. If the contract is not cancelled during the trial period, it converts into the selected paid plan.
(4) Donations via the app stores (Apple/Google) are voluntary and non-refundable, insofar as this is permitted under the terms of the respective store.
§ 5 Term and termination
(1) Free accounts can be ended at any time by deleting them.
(2) Paid plans have the minimum term stated in the plan overview (usually monthly or annually). They are each extended by the original term unless cancelled with one month's notice to the end of the respective term. Cancellation can be made in text form by email to kontakt@racqt.app or via the cancellation function in the user account.
(3) The right to extraordinary termination for good cause remains unaffected.
§ 6 Obligations of the user
(1) The user is obliged to provide truthful information when registering and to keep access data secret.
(2) The user undertakes not to use the platform unlawfully, in particular not to post content that violates laws, the rights of third parties or common decency.
(3) In the event of a violation, the provider is entitled to block the account and terminate the contract for good cause.
§ 7 Availability, maintenance
The provider is entitled to restrict the platform temporarily for maintenance work. Where possible, maintenance work is carried out outside peak usage times.
§ 8 Liability
(1) The provider is liable without limitation for damage resulting from injury to life, body or health, for intent and gross negligence, and under the German Product Liability Act.
(2) In the case of slight negligence, the provider is only liable for breaches of essential contractual obligations (cardinal obligations). In this case, liability is limited in amount to the foreseeable damage typical for the contract.
(3) Otherwise, liability is excluded.
(4) For free services, the provider is only liable for intent and gross negligence.
§ 9 Data protection
The processing of personal data is governed by the privacy policy at https://racqt.app/en/privacy (binding German version: https://racqt.app/datenschutz).
§ 10 Changes to the terms
The provider reserves the right to change these terms with effect for the future, insofar as this is necessary to adapt to changes in the law or to changes in the services and is reasonable for the user. Changes will be communicated to users by email at least six weeks before they take effect. If the user does not object within six weeks, the changes are deemed accepted. This right will be pointed out separately in the notice of change. If the user objects, both parties have a special right of termination.
§ 11 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not conflict with mandatory consumer protection provisions of the state of their habitual residence.
(2) The place of jurisdiction for disputes with entrepreneurs is the provider's registered office.
(3) Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
